Terms & Conditions
1. Overview
This Design Agreement ("Agreement") is made between Bluffton Builders ("Company") and the Client named above for the purpose of developing detailed design plans, estimates, and other necessary documents for new construction and/or remodeling work at the project address listed above. By signing this Agreement, the Client agrees to the terms and conditions stated herein.
2. Scope of Services and Deliverables
Bluffton Builders will provide the following design services for the Project:
• Itemized Estimate — A detailed breakdown of projected construction costs, including materials, labor, and any other relevant expenses.
• 3D Design Elevations — A three-dimensional visual representation of the project, showing proposed design elements for the construction or remodel.
• Product Selection Document — A comprehensive document outlining final choices for products, finishes, and materials to be used in the project. This may include but is not limited to flooring, fixtures, cabinetry, and appliances.
• Construction Plans — If necessary, complete architectural and structural plans required for construction or remodeling work, including any necessary documentation for obtaining permits.
• Preliminary Construction Timeline — An estimated project phases and key milestones for the Client's review.
3. Design Agreement Fee
The Client agrees to pay Bluffton Builders the amount stated above upon signing this Agreement. This fee is non-refundable, regardless of whether the Client decides to proceed with construction or any changes in project scope. This design agreement does not lock the client into a construction agreement.
4. Timeline
The deliverables listed above will be completed within 4–6 weeks from the date of the designer's first visit. It is imperative the client cooperates with the process efficiently and in a timely manner to meet this timeframe. This design contract assumes your design can be completed within 10 hours. Bluffton Builders will alert you when you are getting close to your limit and will provide an amendment to the design agreement for another block of time deemed necessary to complete the design.
5. Termination and Modifications
This Agreement may only be terminated by Bluffton Builders in cases of non-payment or breach of contract. Any changes to the scope of services or deliverables must be agreed upon in writing by both parties, and may result in additional costs.
6. Client Responsibilities
The Client agrees to provide Bluffton Builders with access to the project site and any necessary information or documentation to complete the design phase. Delays caused by lack of cooperation or availability of information from the Client may result in changes to the design timeline.
7. Ownership of Deliverables
Upon full payment and completion of the design services outlined in this Agreement, all deliverables — including the itemized estimate, 3D design elevations, product selection document, construction plans, and proposed construction schedule — will become the property of the Client. Bluffton Builders relinquishes all ownership rights to these materials, and the Client may use them at their discretion for the proposed construction or remodel. However, Bluffton Builders retains the right to use these materials for promotional purposes, such as marketing or portfolio showcases.
8. Acceptance of Agreement
By signing below, both parties acknowledge that they have read, understood, and agree to the terms and conditions outlined in this Agreement.
